Arbitrātor

Arbitrātor (lat.), der Dritte, dessen Ermessen (arbitrium) nach dem Willen der Vertragschließenden oder eines Erblassers bezüglich gewisser Feststellungen, z. B. derjenigen des Wertes einer Sache, der Höhe einer Leistung oder eines Schadens etc., maßgebend sein soll. In der Regel ist dabei das billige Ermessen (arbitrium boni viri) entscheidend. Die von dem A. getroffene Entscheidung oder Bestimmung kann wegen offenbarer Unbilligkeit angefochten werden. Der A. oder Schiedsmann ist nicht mit dem Schiedsrichter (s. d.) zu verwechseln, der an Stelle des Richters einen Rechtsstreit zu entscheiden hat.
