Institutio

Institutio (lat.), Verleihung eines Kirchenamtes. Die höhern Kirchenämter (beneficia majora) werden nach kanonischem Rechte durch Wahl der Kapitel und päpstliche Konfirmation besetzt, die niedern (b. minora) dagegen durch den Bischof frei verliehen. Hat aber nach Herkommen, Privilegium oder Vertrag der Landesherr das Ernennungsrecht der Bischöfe, so überträgt der Papst das Amt an die ernannte Person, und wenn ein Patronatsherr das Präsentationsrecht hat, so überträgt der Bischof das Amt an den Pfarrer oder Benefiziaten ebenfalls durch Institution (I. collativa).
