A limĭne

A limĭne (judicii), »von der Schwelle« (des Gerichts oder einer sonstigen Behörde) weg, kurzweg zurückweisen, ohne daß über die Sache verhandelt wird. Hierzu war das Gericht nach früherm Recht vielfach befugt. Nach der deutschen Zivilprozeßordnung darf auch eine mangelhafte Klage nur nach mündlicher Verhandlung durch Urteil abgewiesen werden, der Vorsitzende muß hierzu (nach § 216) einen Termin bestimmen.
