Common law

Common law (engl., spr. kómm'n lao), in England soviel wie Gewohnheitsrecht im Gegensatze zum geschriebenen Gesetzesrecht (Statute law); dann strenges Recht im Gegensatze zum Rechte, das auf Billigkeit beruht; endlich allgemein gültiges Recht im Gegensatz zu Ortsgebräuchen. In Amerika bedeutet c. l. (gemeines Recht) das ungeschriebene Recht im Gegensatze zum geschriebenen (vgl. Statute law) Recht. Es ist die technische Bezeichnung für alle diejenigen Grundsätze, Gebräuche und Vorschriften, die Personen und Eigentum betreffen und diese sichern und nicht auf ausdrücklichen und positiven gesetzlichen Anordnungen beruhen. Ein Herkommen, das seit Menschengedenken beobachtet worden ist, ohne daß jemand sich des Gegenteils erinnert, eine Maßregel, die seit Menschen gedenken die Bestätigung der Gerichte erlangt hat und ein gesundes und wahres Prinzip von allgemeiner Anwendbarkeit vertritt, das ist dem Amerikaner c. l.
