Mancipation

Mancipation (lat.), im ältesten röm. Recht feierliches Rechtsgeschäft in der Form eines symbolischen Kaufes, wobei außer dem Käufer und dem Verkäufer fünf Zeugen und ein libripens (Wagehalter) vorkommen. Der Käufer ergriff die Sache mit feierlichen Worten, schlug mit einem Stück Erz (raudusculum) an die Wage und übergab es dem Verkäufer. Dies Geschäft diente als Form der Testamentserrichtung, der Übertragung des Eigentums an Sklaven, Zug- und Lasttieren und italischen Grundstücken wie der Bestellung von Grunddienstbarkeiten an solchen, welche Rechte daher res mancipii heißen; ferner, um einen freien Menschen in die manus oder in das Mancipium (s. d.) zu bringen. Man sieht in den fünf Zeugen Repräsentanten der fünf Klassen der Zenturiatkomitien. Die Wage und das Stück Erz erinnert an die Zeiten, da es noch kein geprägtes Geld gab, die Quantität des Erzes also, das den Kaufpreis bildete, durch Abwägung festgestellt werden mußte.
